Spooked horse rider sues biker for £300,000
Paralysed horsewoman seeks compensation from uninsured provisional licence holder
A HORSE rider who was paralysed after her horse was spooked by a motorcyclist is seeking more than £300,000 in compensation.
Ms Shelley Brown, 46, of Hove is suing Ian Surry after an accident which occurred on 18 March 2006 in West Sussex.
Ms Brown states that the speed and the noise of the motorcycle ridden by Mr Surry caused her horse to bolt, resulting in serious spinal injuries. Ms Brown is now paralysed from the chest down.
Mr Surry only held a provisional licence and had no motorcycle insurance. From the High Court writ it appears he was riding negligently with no due care for other trail users and failed to respond to signals from the horse riders to slow down.

agreed, but is jumping fences with a horse not a dangerous pass time in the first place? beside if the general public cant see that a person with no license or insurance is not a motorcyclist, then we are in trouble anyway, as this type of person is an idiot member of the general public who on that day decided to do somthing stupid on a motorbike instead of on a push bike/ in a car / pub etc etc etc

That article is too vague to form an opinion either way on. It seems the 'uninsured for road use' and 'holding only a provisional licence' motorcyclist may not have actually been on the road at all but sharing a 'trail' with the horse and rider. I don't know the legalities of being allowed to do this but nowhere does it say that he was riding on the roads illegally. Also was her horse a very nervous horse? Did she therefore choose a relatively 'quiet trail' but knew there may be the occasional off road bike up and down there? If she lived local to the trail i'm guessing so. A hugely sad event to have happened but typical red-top, rage-inducing, sketchy article writing imo, and not one I feel is fair to form a firing squad on.

Maybe then the army of uninsured tossers out there might realise what they are insuring against. It's rare that insurers go back to a driver, but the NMIB will pursue to the ends of the earth for their money back, which can only be a good thing. As for the rider, he seems a twat for doing what he did and deserves all the shit he's about to face.

although the article doesn't specify it is relevant to note that some trails/paths etc are Highways/roads in law and therefore you commit the exact same offences as you do on tarmac roads..

My mum has an apoluso ( not sure of spelling ), the horse is very good, she rides it on most roads it doesn't spook to bad with cars n bikes, I do get annoyed at some horse riders especially when a bike rider has toned down his throttle given the horse a wide berth and overtaken but yet the rider still feels the need to lean over and hit the biker with a crop.

And he's fcuked if I ever catch him.

FBT - as horses are vegetarian their manure doesn't pose the same health risks as meat eating animals. All the stuff from our stables goes to a local garden centre, who pay top dollar for it

LOL, that's hilarious! I've never done that and have always thanked bikes for slowing down and can't remember a single one that has ever not slowed down.
Car drivers however.... a mini was coming at us really fast - I waved my crop into the road and saw the OLD woman with her purple rinse actually DUCK inside her car as she floored it past us! Horse riders who don't thank drivers/bikers for slowing down are a problem though - I'd hate to be tarred with the brush as those arrogant ignorant tossers. Now - anyone riding in Cheshire that encounters a white pony with me on it - do you want a good spanking with my whip or not?

Pony spankers or not - Let us not forget that a woman has been paralysed by this incident and whether or not this gimp had insurance she won't get use of her legs back. If this happened to one of our loved ones - we'd be devastated. As to horse shit: it is a menace and I always have my 'man' scrape-up after me.... It sounds like she _was_ sensible, which is not a foregone conclusion with horse riders, and he was a complete cnut, which is expected by most people of bikers now. Most of us who ride motorbikes, pushbikes or horses are sympathetic to each other, and its generally the boxes, especially those with 4wd that are the enemy. Well, that's our experience with all of the above, anyway. As someone pretty-much said in an early post, some people will cause an accident whatever they are not-in-control of. We all need to react immediately to dangerous driving asap so less of the 'drivers' think its ok. My very best wishes to ms. shelley brown.

As to the bike rider: I hope he's learned something from this: If it looks like a horse, smells like a horse and sh*ts like a horse -it is a horse!! im 16, and i go to see my best mate at the weekends, he lives down in a little village with narrow roads, and i came across 2 young horse riders and i would say no older than 14, the 1st horse i passed was absolutely fine, and then the econd horse about 50 metres down the road from me was already spooked, my bike was loudish but nothing outrageous,and it was on its hind legs and wondered out in to the middle of the road sideways, so i had to stopright in the middle of the road, but who the hell lets 2 young girls go out on the road? and there is a few cars that do go up that road.in my opinion, they should stick to bridle ways and fields, but for the twat who didnt have any insurance, he gets what he deserves, he could have hit a young kid or something, what would have happened then?

The bigger picture suggests to me that fewer trails will be open to off road riders in the very near future. Stories like this appearing in the media will plant that image of off-road riders being inconsiderate yobs to the public, and will make even more restrictive legislation against trails riders easier to push through. Just a thought.
