HOLLYWOOD BAD boy Mickey Rourke may get away with suspected drink-riding after Miami Beach police officials confirmed the breathalyser test the actor failed a month ago was incorrect.

Rourke was pulled over by police after they claimed to have spotted him weaving all over the road while riding a scooter.

According to reports, they asked the actor to blow into their breathalyser to determine if he was too drunk to ride. The test suggested Rourke was just over the legal limit. But now the authorities have revealed the breathalyser machine that was used was broken. A second machine used later showed the actor was just under the legal limit.

Rourke may still be prosecuted, Miami Beach's District Attorney still has to officially drop DUI charges against the actor.
