Neighbour issue. Small claims court?

ok, to cut a long story short.

My neighbour is a locksmith. He says he wants a bulkhead between the seats in his Kangoo van, and the back, so that his work gear is safe from theft. Being a sheet metal worker, he asks me to sort it, so I take measurements of the inside of his van.

He says he wants 5mm thick stainless steel! I advise him that this is waaay too thick, and total overkill, so he says 3mm thick, and I advise him that mild steel would be cheaper, and easier to work with than Stainless steel. He agrees and tells me to get on it.

I shop around for the metal, trying tog et it as cheaply as possible, 'cause it's a fair size of sheet. all the time, he bugs me with the odd text message along the lines of "you sorted my metal yet? keep up sparky!haha" so, after a week or two, I manage to source some 3mm mild steel, and order it. It gets delivered to my house, and I begin to cut it to shape. It costs me £157, delivered.

He then comes along and says, wooaahh, that's too thick, and tells me to hang fire, because he's thinking about getting a larger van, and I can fit the metal to the inside of his next van, so, I hold off.

He tells me he's been going to van auctions to get a bigger van, and fobs me off with this a couple of times. So, I asked him the other day to make space in his garage for the metal as I need the room in my garage, and he continues to say that the metal is too thick for him, and now it turns out, he's not getting a bigger van....

So, I'm £157 out of pocket, and have two large sheets of 3mm mild steel in my garage, and an idiot for a neighbour who is trying to worm his way out of paying for it, even though he ordered it.

What are my options? Is it worth going through the small claims courrt, or at least threatening him with it? Worth seeking advice from the CAB (although I hear they are a waste of space) I've talked to the company who I got it off, and they don't do returns (Can't blame them, i've chopped it in two) and was going to try get a prce from a scrap yard, then ask him to cough up the rest if they take it for a decent price. (he might not)

I'm not really bothered about upsetting my neighbour, as he's a bit of a twat, but I'm out of pocket, and quite annoyed by this, so suggestions of trashing his van are welcome.

Cheers for any advice.

Have you asked him straight out to pay you?

Not in as many words as "are you going to pay me?"

It's kind of understood that payment would be expected for materials. Labour was going to be free.

I'd ask him to pay for the metal before going to Small Claims. He might just cough up, you never know

give him a written invoice

Give him the bill for the material, and ask him what he wants you to do with it. Offer to give him a hand putting it in his garage.
And take it from there....

Hard cheese, Sparky.

Ask him for the money straight up and if he won't pay put it down to experience. It's hardly worth falling out with the neighbours over that sort of cash and I'm sure you'll find a use for the steel. Then nick the cunt's tools by breaking in through the front of his van.

This is where jobs for family/friends/neighbours fall down. If it was a straight business transaction for a complete stranger all the cards would be on the table before the job was started, that way everyone knows exactly where they stand. It's considerably more awkward now,but not too late to tell him he owes you for the material at least. If he doesn't stump up,then you are in different territory.

Yawn! It's wearing a little thin now, don't you think?

I'd tell him you're a bit skint after Christmas and therefore can he give you the cash he owes you for the metal.

Then give him a week (or until his payday if he asks), and if there's still no sign of the money, stick an invoice through his door.

did you sign a contract with him? I think that will answer any small claims court questions.

That 156 quid could have gotten you a Wii, as it turns out you've been pissed on either way

Now, I know I'm getting old and senile - and indeed smell a little, too - but even I would actually ask to be paid before ripping his throat out.

I wouldn't bother with it. It could spiral and create 'neighbours from hell'.

I think there is a lesson learnt here... don't be nice to people :P

He's coming over later to "have another look at it" apparently. Maybe he thinks it'd got lighter or something?

I'll ask straight out if he's going to pay me, then, I'll take it from there.

He knew he wasn't getting the job for free, so payment for materials was part of the deal.

I don't really care. I'd rather not get on with a neighbour who's a prick than feel like i've been screwed over.

can't you stick it on ebay or sumfink?

you might get some of your cash back at the very least.

True, I agree. but, call me stoopid, but I'm a nice guy. (most of the time)

Although, I'd still do anything for family.

One wanker won't make me jaded enough to help out any friends again either.

I've never checked ebay for this sort of thing. I'll do some homework. The local metal merchants are showing no interest so far. Not sure why though.
