Accident in France: What to do

Alright Guys and Girls,

Whilst in France I was hammering up the motorway towards Calais. It was about 7pm dark and pissing with rain. I had planned to just make it to a petrol station but unfortunately I fell 1000 metres short.

I parked the Hornet in the hard shoulder and started to walk to the Petrol Station. A French couple saw me, pulled over and they gave me a lift to the PS. I filled a bottle with fuel and walked back to my bike.

However, someone had got to my bike before I could. They had got to it in a Peugeot 306 and got to it a bit too quickly it seems.

The guy was apparantly going down the motorway in his 306 when the battery had failed, consequently his lights didn't work so he swerved to the hard shoulder where he managed to plough into the Hornet.

He had a puncture from the collision and I believe this to be the only reason why he stopped. He stopped though which was great.

We exchanged details and spent time down the Gendarmarie, where we sorted out details and I spent time trying to converse with the police in my franglais.

The damage to the Hornet is:

Bent Forks (maybe)
Damaged Head Light
Smashed Clocks
Bent Renthals
Bent Rearsets and gear selector rod
Small chip on swingarm.

The Hornet is insured TPFT for £2400. I'm currently trying to find out what my Insurance Co. did with my claims form

What advice would you give me on what to do next. I'm not riding the bike at the moment although it *can* be ridden.

I do know that in France the car driver is always liable for damage/ injuries to pedestrians, cyclists, passangers in vehicles etc.
If you want some legal advice this lot are very good...Urwin Mitchell 0870 1500 100. They have a specialist department that deals with accidents abroad, if you give them a call they will be able to tell you whether you have a claim.

Sorry to hear this m8 - not a good thing to happen, gutted for you.

Talk to an expert - do you have legal expenses cover? I've had a couple of TPF&T crashes in my time and in all honesty the insurance companies have done nothing for me whatsoever. The legal expenses companies however are great.

I don't think for 1 minute that your insurance being TPF&T will give a flying f*ck - you won't get anything out of them - they may however cover the damage to the 306 if he claims you left the bike in a dangerous position.

You will need to process a claim against the other drivers insurance - as this is in France, well, I just don't know hence the "talk to an expert" bit - the best I think you will get from them is to scrap the bike and pay you out.

Any £2400 bike taking a serious hit is unlikely to be ecocomic to repair and as yours is modded it will be an even harder call (unless all the extra bits had been declared) as they will usually repair to manufacturers original spec.

Oh yeah, even though it wasn't your fauly, you'll probably lose some No Claims Discount as well - sorry for being the harbinger of doom.

Good luck with it.
I had a very close call in the South of France this summer in the car when a prat tried to cut in front of me. Fortunately, my ABS and quick reactions stopped the car dead. He didn't and still tried to steer off the roundabout with locked wheels and ripped out his sump and radiator on the traffic island. He could have just let off the brakes and gone round.....
Fortunately, we didn't touch (must have been bloody close cos I thought we had) otherwise it would have been 50/50 even though it was really his fault. Strange how he knew the recovery telephone number off by heart and he carried a traffic cone in the back of the car.
French drivers? Totally stupid....

Sorry to hear about your bike getting pranged, at least you were not on it or near it at the time, or it could have been you he hit. My hornet sends your hornet get well wishes and a big bike to bike hug.
