Filtering is illegal - Official!

In France, that is

Extract from the french motorcycle press:

The verdict is set in stone. The Ministry of Transport has decided that filtering between lanes of traffic is a prohibited practice.

"Riding between traffic lanes is a grey area in legal terms" explained Catherine Herviou, legal co-ordinator for the French Motorcycle Federation, "so the police are now interpreting certain traffic rules in order to stamp out the practice. On trunk roads and motorways, filtering has recently been classified as undertaking, which attracts a 135 euro fine, three penalty points and a possible ban of up to three years. It is clear that filtering urgently needs to be given a proper legal status"

Filtering has always been tolerated by french motorists, albeit subject to sporadic law enforcement. In June, the CRS nicked over 60 riders who were filtering on the A4 motorway outside Paris. In response, around 400 local bikers staged a hour long demonstration at a nearby motorway toll booth, holding up the barriers and handing out protest information leaflets to 4,000 motorists who were then able to go through without paying.

The demo organisers explained "If filtering was made fully legal, it could be incorporated into driver/rider training. That way, drivers would take more notice of the presence of bikes and riders would learn to ride more carefully between traffic lanes.

Various propositions have been put forward, from riders who reckon that 50km/h between lanes must be practical, to training schools who feel that any speed differential between bikes and cars should not exceed 20km/h.

The transport ministry has received all of these propositions but prefers to preserve the current vague legal situation, an attitude which has satisfied no-one.

Interesting, and
I wonder if there's any political background to this?
I can see advantages in clarifying the law on filtering - here as well. Good point about it then being easier to include it in driver/rider training. Personally I wouldn't mind if something like the '20:20' rule became law, or at least a 'should' in the HWC. Probably more relevant to road safety than a 40 limit on a dual carriageway with no side entrance....

It's a motorcycle, Jim, but not as we know it

The legal situation in the UK is quite clear:

Civil law: crash and it's your fault
Criminal law: ok as long as traffic is slow moving or stopped
DSA: ok if done safely but not to be encouraged.

but if they are going to change the law in france, it would be nice if they included the stupid leg waving too. Nothing wrong with noding or waving, but I can't see the point of the 'is he saying thanks or does he have cramp' effort that the french do.

So your title is slightly wrong then - it should read "Filtering is still a grey area - Official!!"

What happens when you wave with your right hand then? My bike tends to slow down rather abruptly.
Or don't you believe in thanking people who have moved over to let you pass?

Wave your fingers.

Screwd.

I can see that law being obeyed on the Periphique in rush hour....

Last time I was on there, I followed a bike through at upto 90mph. Facking stupid in hindsight, but I certainly wasn't alone with him, and a lot of cars noticed us, and the bikes we passed also noticed us....

True, but on the peripherique most filtering bikes have their hazard lights, which makes them a bit more noticeable.

The French government is turning very very anti-motorist and anti-bikes. The status quo may be a blessing in disguise.

They're now talking about banning PTWs from the streets of Paris on the grounds that they are heavy contributors to pollution.

What's the betting Ken Livingstone is keeping an eye on how things pan out.

I think they've already tried that in Westminster. Some guy was reported as saying if folk take to 2 wheels, what happens is you get more cars [????] and therefore more pollution [???].

I think we've burnt him.

But filtering is already illegal in Germany [didn't know that 'til a few months back].

Great to see the French doing what they're best at : protesting.

There's filtering and then there's filtering peripherique style... if the law makers of France witness peripherique filtering day in day out I'm not suprised they're trying to ban it

They scare the shit out of me every time I go there without fail... and I ride bikes fast for fun so God knows what other motorists must think

It's the same old story but I daresay it's driven by the drive to reduce casualties along with the sprouting of speed cameras all over the French road network
